Keep assets while you pay back creditors at a reduced rate

Chapter 13 bankruptcy provides debt relief for individuals (consumers). Under Chapter 13, you (the debtor) retain ownership and possession of assets while a percentage your future income goes to paying creditors. The amount and payment period is decided based on factors such as your property's value, income, and expenses, And, Chapter 13 does not always require repayment of credit card or medical bills.

Unlike Chapter 7 where your non exempt assets may be liquidated, Chapter 13 enables you to keep assets-including your house and car- while making payments to creditors. Your attorney can work with you on a Chapter 13 payment plan and at a confirmation hearing, the court either approves or disapproves the plan. If the court approves the plan, you retain ownership and possession of all your assets, but you must devote some of your income to repaying creditors over a period of three to five years.

Fill out our initial consultation questionnaire and bring it with you to the first meeting .

During our initial meeting, we will gather basic information from you. We use this time to explain the Chapter 13 bankruptcy process and answer questions you may have.

You will leave with a bankruptcy questionnaire, which you complete at home. In addition, you will need to complete a pre-bankruptcy counseling course and provide us a copy of your certificate of completion before we can file your petition. Information on how to do this is also provided in the bankruptcy questionnaire document.

We review the long questionnaire during our second meeting and prepare your case and paper work for filing.

During your third meeting, you review and sign the paperwork, and we file the case.

Interested clients may also choose our fast-track method, in which the long questionnaire in filled out in advance. We proceed with the last two meetings described above. After we file your case, there will be a meeting of creditors before the bankruptcy trustee at the federal courthouse. The trustee is in charge of overseeing and administering the case. The process is informal and nothing to worry about -- Dana Milby will be at your side throughout the process.
